Losing a family member or loved one will always be one of the saddest times in our lives. Unfortunately, it can be very stressful should certain steps not have been taken, or measures put in place. Probate or rather applying for probate takes place during this early phase of bereavement.
Deeds of Variation
As part of our probate service, our team can also offer you independent advice on the Will itself and may, under certain circumstances, recommend that a Deed of Variation be set up in order to vary the Will. This process would effectively ensure that the beneficiaries of the Will receive as much or little of their inheritance. Ultimately, they do not want to pay out large amounts of tax or miss out on entitlements. This process must be executed within two years of death and with agreement of all the beneficiaries.
Contesting the Will
As part of our service, our team can also offer you independent advice on the Will itself and if you were dependent on the deceased, may under certain circumstances, advise you to contest the Will.

Probate is the legal process of distributing the assets once belonging to the deceased via a trusted executor to the beneficiaries.

Probate is required whenever the deceased owned property/s, isa’s, shares, bonds or has savings of a certain amount in their bank account/s (all specified individually by that bank/building society)

Depending upon the complexity of the estate, will depend upon how long Probate will take. It would be hopeful to complete the process within 8-12 months.
